These Terms and Conditions ("Terms") constitute a legally binding agreement between you (or the organization you represent) and WoWSQL Technologies Private Limited("we", "our", or "us") governing your access to and use of the WoWCareplatform, including the WoWCare web portal and the WoWCare Android mobile application (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not access or use the Service.
1. Definitions
- "Service" means the WoWCare healthcare management platform, including the web portal at wowcare.pro and the WoWCare Android mobile application.
- "User" means any individual who accesses the Service, including administrators, doctors, nurses, receptionists, lab technicians, and any other authorized staff.
- "Organization" means the hospital, clinic, or medical facility that has registered an account and subscribed to the Service.
- "Patient Data" means any health, demographic, or clinical information entered into the Service about a patient by an authorized User.
- "Mobile App" means the WoWCare Android application available on Google Play.
- "Subscription" means a paid or trial plan that grants an Organization access to specific features of the Service.
2. Eligibility and Authority
- You must be at least 18 years of age to use the Service.
- If you are registering or using the Service on behalf of a healthcare organization, you represent and warrant that you have the authority to bind that organization to these Terms and that the organization agrees to these Terms.
- The Service is intended for use by licensed or authorized healthcare professionals and their supporting staff in a professional capacity. It is not for personal or consumer healthcare use.
3. Service Description
WoWCare is a B2B healthcare operations software platform that provides:
- Patient registration, records management, and clinical workflow tools.
- Appointment scheduling, queue management, and triage support.
- Staff attendance tracking, shift management, and role-based access.
- Lab result management and prescription records.
- WhatsApp-integrated appointment request parsing (where applicable).
- Administrative dashboards for organization management.
- Mobile access to all core features via the WoWCare Android app.
We reserve the right to modify, add, suspend, or discontinue features of the Service at any time, with reasonable notice to active subscribers where such changes materially affect the Service.
4. Account Registration and Security
- Organizations must register with accurate and complete information. Each User account must be associated with a real individual employed or authorized by the Organization.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
- You must immediately notify us at hello@wowsql.com if you become aware of any unauthorized access to your account or any security breach.
- We are not liable for any loss or damage arising from your failure to protect your account credentials.
- Sharing login credentials between multiple individuals is not permitted. Each User must have their own individual account.
5. Mobile Application — Specific Terms
- The WoWCare Android app is distributed via Google Play. By installing the app, you agree to these Terms and the Google Play Terms of Service.
- The app requires an active internet connection and a valid WoWCare account issued by your Organization. It cannot be used independently without an Organization subscription.
- You must keep the app updated to the latest available version. Older versions may lose access to the Service if they become incompatible with our backend.
- You must not reverse-engineer, decompile, modify, or distribute the app or any part of its source code.
- Push notifications (if enabled) may be used to deliver appointment reminders or operational alerts. You can disable notifications via your device settings at any time.
- The app stores session tokens locally in secure storage. You are responsible for securing access to your device. Log out of the app when using a shared or unattended device.
6. Acceptable Use Policy
You agree to use the Service only for lawful purposes. You must not:
- Use the Service in violation of any applicable law, regulation, or professional healthcare obligation, including patient confidentiality and data protection laws.
- Enter false, fabricated, or misleading clinical or patient data into the system.
- Attempt to gain unauthorized access to other organizations' data, accounts, or system resources.
- Use the Service to harass, harm, or discriminate against any person.
- Upload or transmit malware, viruses, or any malicious or disruptive code.
- Attempt to reverse-engineer, scrape, copy, or reproduce any part of the Service without written permission.
- Use the Service to store or transmit content that is illegal, offensive, or infringes third-party intellectual property rights.
- Bypass, circumvent, or disable any security or authentication mechanism in the Service.
- Allow unauthorized individuals access to Patient Data or clinical records.
Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without notice, at our sole discretion.
7. Healthcare Data Responsibilities
WoWCare is a software tool. We do not provide medical advice, diagnoses, or treatment recommendations. Clinical decisions remain the sole responsibility of the qualified healthcare professionals using the Service.
- The Organization is the data controller for all Patient Data entered into the Service. We act as a data processor on behalf of the Organization.
- The Organization is responsible for ensuring that its use of the Service complies with applicable healthcare data regulations (including but not limited to laws governing electronic medical records, patient consent, and data retention in your jurisdiction).
- The Organization must ensure that only authorized, appropriately credentialed staff are granted access to the platform.
- We are not liable for errors in Patient Data entered by Users, or for clinical decisions made based on information in the platform.
8. Subscriptions, Billing, and Payments
- Access to paid features of WoWCare requires an active Subscription. Subscription plans, pricing, and features are detailed on the pricing page.
- Subscriptions are billed on the cycle stated at the time of purchase (monthly or annually). Billing is handled through our payment provider; we do not store full card or bank account details.
- Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.
- Fees paid are non-refundable once the paid term begins, except where required by applicable law.
- If payment fails, we may suspend access to the Service. Access will be reinstated upon successful payment.
- We may change subscription pricing with at least 30 days' written notice. Continued use after the price change takes effect constitutes acceptance of the new pricing.
- Subscription management and billing are handled exclusively through the WoWCare website. Subscriptions cannot be purchased or managed through the Android mobile app.
9. Intellectual Property
- The WoWCare platform, including its software, interface, branding, design, documentation, and underlying technology, is owned by WoWSQL Technologies Private Limited and protected by applicable intellectual property laws.
- Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for your Organization's internal healthcare operations during your active Subscription term.
- You retain ownership of all data and content your Organization inputs into the Service. You grant us a limited licence to process that data solely to provide the Service.
- You must not use our brand name, logo, or trademarks without prior written consent.
10. Availability and Service Levels
- We aim to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. Scheduled maintenance, infrastructure updates, or third-party outages may cause temporary unavailability.
- We will make reasonable efforts to notify Organizations in advance of scheduled downtime.
- The Service is not intended to be used as the sole record-keeping system in emergency or critical-care situations where availability cannot be guaranteed.
11. Confidentiality
Each party agrees to keep the other's confidential information (including Patient Data, pricing, and technical details) confidential and not to disclose it to third parties except as necessary to perform obligations under these Terms or as required by law. This obligation survives termination of the agreement.
12. Termination and Suspension
- By you: You may stop using the Service and request account closure at any time by contacting hello@wowsql.com. Termination does not entitle you to a refund of prepaid fees.
- By us: We may suspend or terminate your account or access to the Service immediately and without notice if: (a) you violate these Terms or our Acceptable Use Policy; (b) we are required to do so by law or court order; (c) payment is overdue after reasonable notice; or (d) your account poses a security risk to the platform or other users.
- Effect of termination:Upon termination, your right to access the Service ceases. We will retain your Organization's data in accordance with our data retention schedule and applicable law, after which it will be deleted or anonymized. You may request a data export before termination by contacting us.
13. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free from harmful components.
WoWCare is a software platform and does not provide medical advice, clinical diagnoses, or treatment recommendations. All clinical decisions are the sole responsibility of the qualified healthcare professionals using the platform.
14. Limitation of Liability
To the maximum extent permitted by applicable law:
- WoWSQL Technologies Private Limited and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising from your use of or inability to use the Service, including loss of data, revenue, profits, or patient records, even if we have been advised of the possibility of such damages.
- Our total aggregate liability to you for any claims arising under or related to these Terms or the Service shall not exceed the amount you paid us in subscription fees in the three (3) months immediately preceding the event giving rise to the claim.
- These limitations apply regardless of the legal theory of liability (contract, tort, negligence, strict liability, or otherwise).
15. Indemnification
You agree to indemnify, defend, and hold harmless WoWSQL Technologies Private Limited, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of or access to the Service; (b) your violation of these Terms; (c) your breach of any applicable law or regulation, including healthcare data protection laws; or (d) any claim by a third party relating to data you entered into the Service.
16. Privacy and Data Protection
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you agree to the collection and use of information as described in the Privacy Policy. The Organization, as data controller for Patient Data, is responsible for obtaining any necessary patient consents required by applicable healthcare and data protection regulations.
17. Third-Party Services and Links
The Service may integrate with or link to third-party services (such as WhatsApp for appointment request parsing, or payment providers for billing). We are not responsible for the terms, privacy practices, or content of any third-party services. Your use of those services is governed by their own terms and policies.
18. Modifications to These Terms
We may update these Terms at any time. We will notify you of material changes by updating the effective date at the top of this page and, where required, by sending an email notification or displaying an in-app notice. Your continued use of the Service after the effective date of any revision constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Service.
19. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of India. Any dispute arising out of or relating to these Terms or the Service shall first be submitted to good-faith negotiations. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the competent courts in India.
20. Miscellaneous
- Entire Agreement: These Terms, together with the Privacy Policy and any applicable subscription order, constitute the entire agreement between you and WoWSQL Technologies Private Limited regarding the Service.
- Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
- Waiver: Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
- Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
- Force Majeure: We are not liable for delays or failures in performance caused by circumstances beyond our reasonable control, including natural disasters, government actions, internet outages, or third-party infrastructure failures.
- Language: These Terms are written in English. In the event of any conflict between an English version and a translated version, the English version prevails.
